Montana's Sexual or Violent Offender Registration Act is designed to protect the public from sexual and violent offenders by requiring offenders to register with local law enforcement agencies in the jurisdiction where they will reside. Information about these offenders is then made available to the public.
The Legislature has acknowledged that a compelling interest exists for providing the public with information about persons convicted of sexual and violent offenses. This information can help the public adequately protect themselves and their children from sexual and violent offenders. However, the information should not be used to threaten, intimidate or harass registered offenders. In fact, abuse of this information could result in restrictions being placed on its availability.
Although the Montana Department of Justice maintains the registry, it has no legal authority to direct where a sexual or violent offender may or may not live. Unless court-ordered restrictions exist, these offenders are constitutionally free to live wherever they choose.
